Earlier this month, Ecuador?s National Assembly passed legislation that would nationalize the country?s private credit reporting industry.

President Rafael Correa has to decide by November 4 whether or not to sign it. The legislation would permit only the government?s central public data agency to provide credit reports and scores.

Private credit bureaus (domestic and foreign) would be nationalized and put out of business as private entities. The new law would also force them to hand over to the government?without compensation?their data about the credit histories of private citizens and companies.

This law directly violates Ecuador?s written commitment under the World Trade Organization?s (WTO) General Agreement on Trade in Services (GATS), in which the country promised never to impose market restrictions or national limits on the provision of credit reference services.

Ecuador?s Association of Private Banks has announced its opposition to the measure, noting that it would give monopoly power over citizens? sensitive, private financial information to the government and potentially transform it into what one Ecuadorian journalist calls ?Big Brother? (Gran Hermano).

As the World Bank?s ?Doing Business? survey and other reports note, public credit registries and private credit bureaus expand access to credit and contribute to economic growth and poverty reduction. It is the poor who lose when restrictions are placed on access to finance (e.g., micro lending and micro borrowing). As Heritage has reported, Ecuador?s government has taken numerous other steps recently that weaken the rule of law.

Despite the worsening market conditions, President Correa has an opportunity to propose changes to the law to keep private credit bureaus in business and send a signal at home and abroad that he sees a future for Ecuador?s market economy. Let?s hope he does.

California city bans smoking in multi-unit housing

SAN RAFAEL, Calif. - A San Francisco suburb on Monday banned smoking in duplexes, condominiums and other multi-family homes, with city leaders saying they hoped to lead a wave of such regulations across California and ultimately the country.?

The City Council in San Rafael, a community of 57,000 people about 15 miles north of San Francisco, voted unanimously for the ban, following a handful of other California municipalities that have outlawed smoking in buildings with as few as two units.?

"We are happy to blaze a trail," Mayor Gary Phillips said before the vote. "We're most happy to be in the forefront of the issue because we think it will greatly benefit our residents and those visiting San Rafael, and we think it will set the tone for other cities as well."?

Tobacco-control experts predicted that the tough smoking ordinance in San Rafael could touch off a larger movement in other states and cities.?

"The San Rafael ban is a very significant event because it will spread," said Robert Proctor, a Stanford University history of science professor. "We're on the downslope of a big curve. Smoking peaked in 1981 with 630 billion cigarettes sold in the United States. Now it's down to 350 billion. And that number will keep on going down until smoking is a distant memory."?

San Rafael is the state's ninth municipality to completely restrict smoking in multi-unit housing, said Pam Granger, advocacy manager for the American Lung Association in California. Granger said California was the only state where local jurisdictions have banned smoking in homes.?

Supporters of the San Rafael measure say it would protect bystanders from the health hazards associated with secondhand smoke, a known carcinogen that can seep through ventilation ducts, doorways and open windows in residential units with shared walls, California Watch reported.?

Although the ordinance has generally been supported by residents who have spoken at city council meetings, the proposal has set the stage for a fierce fight over how far the government should go in regulating peoples' private lives.?

"This proposed smoking ban actually intends to punish people for what they do in their own homes," Thomas Ruppenthal told the city council. "I really feel this is tyranny."?

City officials say they have received roughly 30 emails and calls from residents who say the ban would leave smokers with few places to go, California Watch reported.?

The ordinance also would prohibit smoking on San Rafael's downtown streets - the backdrop for parts of the 1973 film "American Graffiti."?

But the restrictions have become increasingly strict, and San Rafael's ordinance applies to all homes, new or existing and rented or owned, with shared walls.?

JERUSALEM (AP) ? Amal Ashour, 18, loves Shakespeare and American pop music. One of the brightest students in the Gaza Strip, she studied her senior year of high school in Minnesota through a U.S.-government funded program.

She had planned to study English literature this fall at a university in the West Bank through another U.S.-sponsored program, but just a month before school started, she was informed the scholarship was no longer available.

"When you live in Gaza, you're a pawn in a greater political game," she said in a telephone interview. "There's nothing we can do about it." She is now enrolled at Islamic University, a stronghold of Gaza's ruling Islamic militant Hamas.

Under Israeli pressure, U.S. officials have quietly canceled a two-year-old scholarship program for students in the Gaza Strip, undercutting one of the few American outreach programs to people in the Hamas-ruled territory. The program now faces an uncertain future, just two years after being launched with great fanfare by U.S. Secretary of State Hillary Rodham Clinton during a visit to the region.

The program offers about 30 scholarships to promising but financially challenged Palestinian high school seniors from Gaza and the West Bank to study in local Palestinian universities.

It is a rare opportunity for gifted students in Gaza, which has been constrained by an Israeli blockade since Hamas seized power five years ago. The blockade has made it harder for Palestinians to travel abroad. Both Israel and the U.S. consider Hamas a terrorist group because of its hundreds of attacks against Israelis, including suicide bombings, and frequent rocket attacks from Gaza.

After allowing the scholarship program to proceed in 2010, Israel this year refused to give permits for the Gaza students to travel to the West Bank. Hamas' rival, the Western-backed Palestinian Authority, governs the West Bank.

Citing security reasons, Israel bans most Gazans from traveling to Israel or the West Bank. Exceptions are made for about 5,000 humanitarian cases each month.

Education is not considered a humanitarian concern. Israeli officials claim that West Bank universities are breeding grounds for militant groups like Hamas. Last month, Israel's Supreme Court upheld this travel ban on students.

Israeli military spokesman Guy Inbar said the policy is part of Israel's struggle against Hamas, an Iranian-backed group committed to Israel's destruction.

"Hamas makes great efforts to establish new affiliates of the terrorist infrastructure from Gaza to the West Bank, and to transfer knowledge to strengthen the existing infrastructure in the West Bank today," Inbar said. He noted that nearly 300 Gaza students have been able to leave the region to study abroad since 2010.

The Palestinians seek to turn Gaza and the West Bank, located on opposite sides of Israel, into an independent state. But since the Hamas takeover, the Palestinians have been torn between rival governments, and Israel has treated them separately. Israel maintains relations with the Western-backed Palestinian Authority in the West Bank, while branding Hamas-run Gaza a hostile territory. Repeated attempts by the Palestinian rivals to reconcile have failed.

In a statement, the American consulate in Jerusalem said it decided not to grant the scholarships over the summer after Israel said it would not permit the students to travel. "Because of the timing and risk of losing funding, available scholarships were awarded to other applicants," it said. "We hope to include Gazan students in future programs."

The scholarship program, administered by the nonprofit group Amideast, is one of the few contacts between the U.S. and Hamas-ruled Gaza.

Sari Bashi, director of Gisha, an Israeli advocacy group dedicated to increasing the free movement of Palestinians, said the case reflected U.S. unwillingness to confront a strong ally.

"It's unfortunate and telling that the U.S. government cannot convince its closest ally in the region to allow its scholarship holders to travel from Gaza to Palestinian universities in the West Bank, for fear of clashing or making a diplomatic issue," she said.

Hamas, meanwhile, has also jumped in. Last year, it barred seven high school students from traveling to the United States for a year of study under a U.S. program, citing worries over their supervision.

Ashour said students like her are caught in the political battle and stand to lose the most.

"When I studied in America, I loved how you could travel from state to state without any borders. You live your life," she said. "I can't leave Gaza. Everyone ? Hamas, Israel, everyone ? is controlling us. We are just students. We don't have anything to do with politics."

The $1,000 Genome Is Almost Here- Are We Ready?

The era of the $1000 genome, which is all but upon us already, is a new era of predictive and personalized medicine during which the cost of full genome sequencing for an individual or patient drops to roughly $1,000.

Think about what personalized medicine can do: having access to your own genome information will open the doors to dozens of men and women wishing to find out if they have gene variants associated with Alzheimer?s, diabetes, heart disease or cancer. In some circumstances this genome map will also help your doctor determine which drugs you should consider taking and at what dosage, which if accurate enough would be much more efficient than the current approach. Sounds great doesn?t it?

You probably heard something like this back in 2000 when Bill Clinton mentioned the completion of the Human Genome Project in a speech and suggested that humanity can cure any disease and reveal the secrets of our evolution. Well, back then we didn?t have a clue what this 3 billion letter code would bring upon us in terms of storing and handling it and properly analysing it. Only the most savvy IT experts and bioinformaticians foresaw what the technical impact would be, and the side effect of the ensuing flood of data certainly didn?t make revealing the secrets of evolution particularly easy.

Twelve years on, the target users of the $1000 genome are scientists at R&D companies and academic institutions, and the occasional wealthy businessman or celebrity such as Ozzy Ozbourne. But so far they?ve all paid much more than $1000. Steve Jobs, for example paid $100,000 for his genome to be sequenced and analyzed, when he was fighting with cancer. Admittedly the higher price was a year or so ago, so with the continuing decline in sequencing costs you may well now get a number closer to the $1000 if it is just for sequencing, but without analysis.

If some analysis needs to be done, have a look at this article in Forbes which describes a $4000 genome scan but only covering a fraction ? 0.02% ? of the full genome. This type of sequencing is often used for sequencing targeted areas of cancer tissues in order to find the mutations which triggered the cancer.

The $1000 genome figure refers to a full genome scan, much more than what is covered in the Forbes example. Whole genome sequencing covers the complete genome, all 3 billion bases of it, 99.9% of which is identical to every other human, and indeed 99% identical to chimpanzees and bonobos.

Life Technologies announced this year that they can already scan the full genome for $1000, and another company called Geniachip claims to go beyond this and deliver the same results for just $100. It will be interesting to see how good the quality of this $100 genome is!

Given that 99.9% of the genome is identical in all individuals, full genome sequencing is largely unnecessary ? at least, if we believe that we are sure that all the information we need is in the remaining 0.1%. The recently published ENCODE project found some individually unique traits within that supposedly constant 99.9% genetic sequence which means that we definitely do not know as much about what makes each genome individual as we might have previously thought.

Exome sequencing is a lighter option which will cover only the 1% of your genome that is coding sequence ? i.e. translated into proteins within your body. This type of sequence will still not include the features that the ENCODE project suggests might exist in the non-coding regions, but it is suited well to current knowledge about the individual variations that can be found in humans. It is offered to the general public by 23andMe and other similar companies and can cost as little as $299 when offered as a commercial service.

To sequence the genome is just the start. Storing it and analysing it can turn out quite pricey. To store only the basic sequence data (no quality scores or ambiguous results) from your fully sequenced human genome you will need roughly 780MB. This can easily be stored on a DVD, which is not expensive at all, but for companies sequencing many human genomes, and certainly for any research where the quality information is as important as the sequence itself, they will need much bigger storage than a single DVD. In-house data centers are the default choice, but the growth in data is outpacing the growth in storage available in these facilities. That is why many of them have embraced the power of the cloud technologies, such as Amazon Web Services.

Analysing genome data includes comparing it to the reference genome to see how different you are from the others. This requires powerful computers working together and running your DNA through some relatively complex analysis pipelines. More advanced analysis to obtain detailed information or to answer very specific questions comes with a complexity (and cost) that depends on the expected outcomes. As mentioned above, Steve Jobs paid $100,000 for his genome to be sequenced and compared to the reference genome to find the mutations which triggered the cancer ? only a fraction of this would have been the actual sequencing cost.

The science community has the technology to read and assemble the human genome, to efficiently store it, and run suitable analyses. But to achieve a broader embrace of the $1000 genome, the public itself will need more education on the mechanics and benefits of personalized medicine. Limited or incorrect information can cause dangerous misunderstandings and illogical fear or bias against the technology amongst the public, and poor interpretation of the results by amateur geneticists might have serious negative side effects on health. Governments will have to incorporate into the current medical system ways to educate both health practitioners and patients with knowledge on how to interpret the results and be sure that they act appropriately upon them.

There is a very good scenario of a moment in the near future, mentioned in a Forbes blog post by Jim Golden: ?The challenge for the clinical oncologist (GP) is the informed patient who says ?I want to have my genome sequenced so we can pick the best drug. Here?s $1000.? It is worth a read.

If Jim?s patient had got their genome sequenced directly, then despite all the disclaimers provided by the supplier they may still misinterpret the information without understanding that it is far from sufficient for what is required to know, for example, that there is a 95% chance they will have Alzheimer?s disease. In their position, even if you could rely on this disease prediction, what would you actually do about it? Is it better to know but be unable to treat it, or not know and never worry about something you couldn?t treat anyway?

Bottom line is, scientists are ready for the $1000 genome, but the governments, the medical system, doctors, and the general public are almost certainly not.

(AP) ? A former stock broker was arrested early Monday on charges he directed an elaborate fraud on Broadway starring fictitious investors ? a scheme that doomed the musical adaptation of Alfred Hitchcock's psychological thriller "Rebecca."

Mark Hotton, his wife and three associates also were charged in a separate money laundering scheme on Long Island. They were awaiting a court appearance later Monday.

Federal prosecutors in Manhattan accused Hotton of conning the "Rebecca" producers by convincing them he had lined up $4.5 million in financing and the possibility of a $1.1 million loan for the show. In return, they said, he collected tens of thousands of dollars in commissions.

"Mark Hotton perpetrated stranger-than-fiction frauds both on and off Broadway," Manhattan U.S. Attorney Preet Bharara said in a statement. "Hotton concocted a cast of characters to invest in a major musical - investors who turned out to be deep-pocketed phantoms. To carry out the alleged fraud, Hotton faked lives, faked companies and even staged a fake death, pretending that one imaginary investor had suddenly died from malaria."

The planned Broadway production of the 1938 novel collapsed earlier this month amid questions about its financial backing, and a growing suspicion that one of its primary investors ? a secretive businessman named Paul Abrams who had supposedly pledged $4.5 million, then suddenly died ? never existed.

Lead producer Ben Sprecher "is extremely gratified that Mr. Hotton has been taken into custody," said his attorney, Ronald Russo, adding that Sprecher has "cooperated completely with the investigation."

"Mr. Hotton's fraudulent conduct did enormous damage to Broadway and to 'Rebecca,'" Russo said. "Mr. Sprecher is totally committed to bringing 'Rebecca' to New York."

Hotton was charged with two counts of wire fraud, each punishable by up to 20 years in prison. His attorney, Heath Berger, did not immediately return a call for comment.

According to the criminal complaint unsealed Monday, Hotton tricked the producers into believing he had secured the money from four overseas investors, who weren't real. The producers agreed to pay Hotton $15,000 in fees and commissions between March and June 2012, prosecutors said. He was also paid an additional $18,000 "advance" against his 8 percent commission, they said.

When it became obvious that investors' commitments would fall through, Hotton allegedly tried to broker a $1.1 million loan for the producers, prosecutors said.

The prosecutors say Hotton "enlisted his same cast of invisible men to carry out a real estate scam." They did not name the Connecticut real estate company.

Hotton also was accused of using a similar scheme to con a Connecticut-based real estate company into paying $750,000 to him and entities he controlled, Manhattan prosecutors said.

In the separate Long Island case, federal prosecutors in Brooklyn accused Hotton and his wife of cheating business partners out of $3.7 million.

An indictment alleges that the couple, while operating three electrical contracting companies, created fake invoices showing money owed by third parties. They then allegedly sold the purported debts to other companies.

What Are Infographics?

I found many definitions of what Infographics are as well as explanations of how they are useful in a variety of settings. Here are a couple of the definitions I liked followed by their sources:

Information graphics or infographics are graphic visual representations of information, data or knowledge. These graphics present complex information quickly and clearly, such as in signs, maps, journalism, technical writing, and education. With an information graphic, computer scientists, mathematicians, and statisticians develop and communicate concepts using a single symbol to process information. (Wikipedia)

An umbrella term for illustrations and charts that instruct people, which otherwise would be difficult or impossible with only text. Infographics are used worldwide in every discipline from road maps and street signs to the many technical drawings. (PC Magazine)

An easy-to-read illustration that helps tell a story and makes data points easier to understand. And it doesn?t hurt when infographics are not only clear and straightforward but also beautiful and engaging. The aesthetic design draws the viewer in; the information helps the viewer analyze and understand the data being presented. (Visual.ly)

These three examples do a nice job of defining what infographics are, but what is the value of an infographic in education? I?m glad you asked because this video does an excellent job of demonstrating how valuable they can be if they are used effectively in an educational setting.

The Science Behind Infographics

Now that we have a basic understanding of what infographics are, This refers to the part of the video where the narrator asks the viewer to count the number of 7s in the number set. The video explains that comprehension becomes almost instant due to preattentive attributes, or ?visual clues? like size, color, and orientation that the brain processes in 250 milliseconds (msec). This chart shows a list of preattentive attributes that infographics use to convey their message clearly.

According to research by Mark Smiciklas, author of the book The Power of Infographics: Using Pictures to Communicate and Connect with Your Audiences, ?one of the primary reasons infographics work well as a communication tool can be linked to eyesight and the neurological connection of our eyes and brain.? He goes on to discuss how our brains are hard wired for infographics because vision directly accounts for 50% of our brain?s real estate. Since we are already built to consume information visually, infographics might be easier to process than pure text.

Smiciklas also notes that ?Robert Lane and Dr. Stephen Kosslyn offer an explanation for what the brain sees when it comes to pictures vs. words. Each letter in a word is essentially a symbol. To read text, the brain needs to act as a decoder first, matching those letters with shapes stored in memory. From there the brain must figure out how all the letters fit together to form words, how words form sentences, and how sentences form paragraphs.

Although all this comprehension takes place in only a split second, relatively speaking, when compared to how the brain deals with images, the process requires considerably more mental effort.?

Using infographics in instruction is an innovative and engaging way to ensure that the message you are sharing is visually appealing and easily digested by your students.

They allow students to comprehend, interpret, and analyze complex information in a quick and clear manner. Do you have a zero-tolerance policy for workplace violence? That doesn?t mean you have to fire everyone who violates the letter of the rule. You can use some discretion, as long as you document why.

Recent case: Pavel was born in the Soviet Union, and is a legal U.S. resident. He worked the night shift in a U.S. Foodservice warehouse, where he filled orders.

One night, he allegedly screamed profanities and racial slurs at a black employee from West Africa who did not understand much English. Pavel also pushed him. The employee was in tears and his co-workers complained about how he had been treated. The company investigated and fired Pavel for violating its no-violence policy.

Pavel sued, alleging national-origin discrimination. He claimed that a non-Russian employee kept his job even though he brought a gun to work, which also violated the policy.

But U.S. Foodservice explained why it didn?t fire the gun-toting employee: He was licensed to carry the weapon and apparently forgot he had it with him when he arrived at work. He immediately went to ?management and explained the situation. At no time did he threaten anyone or even show the gun.

The court said that Pavel?s behavior was different and the employer was within its rights to punish the two differently. It dismissed the case. (Ignatenkov v. U.S. Foodservice, No. 1:11-CV-232, SD OH, 2012)

Final note: The key is to carefully document violent incidents and apply the facts to the policy. In this case, Pavel?s behavior clearly was more immediately dangerous. Plus, he exposed his co-worker to slurs that could have created a racially hostile work environment. That was true even though the West African employee may not have understood exactly what names he was being called or why.

    Linux Foundation proposes convoluted solution for UEFI Secure Boot

    With Windows 8 Microsoft is pushing manufacturers away from a traditional BIOS to UEFI with Secure Boot. But that poses problems for alternative OSes like Linux, because UEFI requires any software have a signed certificate. The Linux Foundation has been looking for a solution and thinks that it may have one. The proposed work around is a little convoluted and surprisingly involves obtaining a Microsoft signature for a new barebones bootloader. This wouldn't actually boot Linux or any other OS actually. Instead, it would then start a second bootloader, the one associated with your OS of choice. It's a little messy, but it should mean that the signed bootloader will be a catch-all solution for any operating system. Of course, it could take a while for the Foundation to actually obtain a signature from Microsoft. So "Designed for Windows 8" systems might not be able to run Linux right away, but rest assured a solution is on the way.

    Broad Pros and Cons of Cloud Computing for Enterprise IT ...

    As we have characterized through the first few posts on the topic of whether, in fact, it is inevitable that enterprise IT organizations will, en masse, migrate over to cloud computing options from on premises systems, it is now more than likely that, over the next near term, an increasing portion of these organizations will opt to proceed on a migration to either public or private cloud systems offered as a managed service by either ISVs, their OEMs, or their partners. The options include, as we just mentioned, managed services for either pure cloud computing or a hybrid combination of cloud and on premise systems.

    Pros
    The positive results of this likely trend include a lot healthier set of ISVs. Should enterprise organizations migrate, then ISVs will achieve a substantially lower cost of development, delivery, implementation and ongoing support for their customer bases. Margins should improve ? at least initially ? as OEMs and channel partners are forced to assume new roles, in order to accomodate the drastic changes in the market that will result.

    Enterprise IT organizations should, themselves, benefit from reduced costs of support as well as a different purchasing structure that emphasizes periodic payments for 100% pure business expenses, in the form of monthly/quarterly/annual services subscription costs. In fact, a larger portion of the support requirement will be assumed by the ISVs, themselves. We, ourselves, subscribe directly to Microsoft?s Office 365 E3 plan, including the Dynamics CRM add on. Almost all of the task of customizing the applications that we receive have been assumed by Microsoft. The result has been zero additional cost for us beyond our monthly usage charges. We think that much larger businesses are enjoying even more favorable treatment under this offer.

    Cons
    But there are drawbacks that will accompany this trend. For ISVs, as we have just noted, a new requirement, to support end users, will have to be handled. As well ? and we think, ultimately, of much greater importance ? we think that ISVs will have to assume some substantial portion of the burden of security assurance, which portion will likely include indemnifying customers from the cost of security breaches, etc.

    The entire security question is a two edged sword, for enterprise IT organizations as well as ISVs/OEMs/Partners. If ISVs abdicate, then market messaging ? that cloud options are reliable, secure, and entirely dependable ? will be compromised and worthless. On the other hand, if ISVs opt to indemnify customers from the costs of security problems, then a substantially higher operating cost may, in fact, arise.

    In the next post we will look at how security vulnerabilities can end up as a ?con? for enterprise IT organizations, as well.
